«Rosgranitsa» affair reached beyond common sense borders

An Investigative Committe of Ministry of Internal Affairs is preparing the documents for international search of  Dmitry Bezdelov, the former Head of «Rosgranitsa».  The inquiry is not confused by the fact that the construction of the railroad checkpoint “Adler” is successfully completed and the assigned money were almost disbursed and accuses Bezdelov of acquiring the reconstruction money. The contradicting statements of other parties involved in the case, who signed pre-trial agreements with the inquiry, somehow outweigh common sense.


The legacy of the corrupted general

The «Adler» railroad checkpoint was to be reconstructed as part of the programm of organising and holding XXII Winter Olympics and XI Paraolympic Games in Sochi. For these purposes the Governement assigned «Rosgranitsa» 1 175 220 000 roubles and at the end of 2013 the checkpoit was successfully presented to the state committee. This fact, however, did not prevent the Investigative Department of the Russian Ministry of Internal Affairs (MVD) to initiate investigation into the fact of fraudulent theft of all the money assigned for the reconstruction.

The subordinates of the General Denis Sugrobov, the former Chief of the Head department of economic security and counteraction to corruption of the Investigative Department of the Russian Ministry of Internal Affairs (MVD) provided operational support in the case. At the moment General Sugrobov is under arrest and is accused of corruption and for malfeasance. A federal search warrant is issued for Mr. Bezdelov and soon to be changed into an international search. Although an ordinary common sense allowed to hope that after the leave of general Sugrobov from the Investigative Department of the Russian Ministry of Internal Affairs (MVD), the inquiry might change its stance to Dmitry Bezdelov.

However, this did not happen.


Special status

According to the inquiry, in November 2009 «Rosgranitsa» (the contractor), «Rosgranstroi» (the conractor-developer) and head contractor LLC “Reconstruction department 5” (“RSU 5”) signed a state contract for the reconstruction of railroad checkpoint “Adler”, that had to be completed no later than the December 31st , 2010. The project was financed in full up to a completion stage. According to the inquiry Dmitry Bezdelov, the head of “Rosgranitsa” and his subordinates Oleg Senkevich and Danila Vavilov, as well as Georgy Belousov, Director General of “RSU 5”, stole 1.176 bln roubles assigned for the reconstruction of borders.

Presently this case has six accused individuals. Besides Dmitry Bezdelov it includes government officials and former «Rosgranitsa» and «Rosgranstroy» employees – Danila Vavilov, Oleg Senkevich and Sergey Kozlenkov. Evgeniy Chaika and Georgiy Belousov are the representatives of the local businesses The two of the accused – Vavilov and Belousov have a special status, they signed a cooperational agreement with the inquiry. However, Belousov's status is the most special, because upon his statement the criminal case was initiated and according to his statements the inquiry justifies the accusation of Dmitry Bezdelov.

However, if the inquiry applied minimal effort to study the real state of what had happened, the story would have looked differently.


Plain arithmetic

According to the version of the Investigative Committee of the Ministry of Internal Affairs of the Russian Federation (MVD), Dmitry Bezdelov took part in fraudulent theft of almost 1.2 bln roubles from the budget, which the state had assigned to his department in order to reconstruct the checkpoint “Adler”.

So, what happened to this money?

Partially the work from “RSU 5” was admitted by “Rosgranitsa” when Bezdelov still headed it – the Arbitration Court of St. Petersburg and Leningrad region confirmed that the works were lawfully admitted. Both court decisions came into force and the cost of works was estimated at 351.4 million roubles.

Moreover, within the state contract for the reconstruction of “Adler” a special equipment for border control was installed at the checkpoint. This equipment, installed by subcontractor “Escort Centre” costed 178.8 mln roubles.

 Additionally for the whole sum that was paid to “Rosgranitsa” for the work, a GST in the amount of 163.8 mln roubles was paid.

An elementary calculation shows: 351.4+178.8+163.8=694 mln roubles. This amount was definitely paid for the reconstruction of checkpoint “Adler”. Therefore it couldn’t have been stolen. Hence, a question arises: Why doesn’t the Investigative Department of the Russian Ministry of Internal Affairs (MVD) notice such obvious things?  How is the State prosecution going to prove the fact of stealing this money?

Moreover, the stealing of the rest of 481.2 mln roubles is questionable.


Not admitted doesn’t mean stolen

The admittance of the completed construction object by the state department holds more to it than the people think. Every construction work that was carried out within a state contract must strictly comply with project documentation. In case of checkpoint “Adler” this meant that “Rosgranitsa” couldn’t admit the completed buildings if the heating was not connected to the pipes. “Rosgranitsa” could not admit from contractor general transformer station if it was not connected to all the necessary communications.

However, if these construction objects are officially not admitted it doesn’t necessarily mean that they don’t exist and that the money assigned for their construction were stolen. Moreover, before general Sugrobov was himself arrested, he came to “Adler” and could be reassured that the real state of things there wasn’t that bad. However, he made up completely different conclusions.

In the mean time during the arbitration process, when “Rosgranitsa” made claims to “RSU 5”, a construction-technical expertise was assigned by court. According to the conclusions of the expert, on December 31, 2010 the amount of works that had been performed at the checkpoint was estimated at 846.2 mln roubles. The approximate cost of works that had to be carried out in order to complete “Adler” and to present it to “Rosgranitsa” was estimated by experts to 211.5 mln roubles. These calculations were proved later – at the end of 2013 “Adler” was successfully completed by another subcontractor to which “Rosgranitsa” paid out approximately 200 mln roubles.

It’s worth noting that the expertise results were announced at one of the seatings of the Arbitration court of St. Petersburg and Leningrad Region. This was carried out by expert Bakhtin, who testified as a witness during process and  was warned of the criminal responsibility by giving false statements.

Actually such expertise as well as other could’ve been assigned by the inquiry, which however didn’t see it as necessary. In fact, the Investigative Department of the Russian Ministry of Internal Affairs (MVD) concluded out of the blue that all the money assigned for the reconstruction of checkpoint “Adler” were stolen!


Some other peculiarities

With the help of mass media and in its own documents of process the inquiry mentions two really strange arguments, that supposedly point to the guilt of Dmitry Bezdelov.

The first argument is a statement that Dmitry Bezdelov, when he was still the head of “Rosgranitsa” initiated a bankruptcy procedure of “RSU 5”. This argument supposedly give an impression that a former high ranking government official wanted to cover the tracks after stealing the money from the budget, by making a subcontractor a bancrupt, with whose assistance the money were stolen. However if one looks at the website of the Arbitration court of St.Petersburg and Leningrad region, he will see that the bankruptcy of “RSU 5” was initiated by Assembly and Construction Department 78, which has nothing to do with the state contract between “Rosgranitsa” and “RSU 5”. And only much later “Rosgranitsa” according to law regulations entered as a creditor of “RSU 5” in this bankruptcy case.

The second, evidently dubious argument is the statement that the money assigned by the government for the reconstruction of checkpoint «Adler» went to «Agrosoyuz» bank not by mistake, but because one of the bank co-owners is Alexandr Bezdelov, the father of ex-owner of «Rosgranitsa». Indeed, «Rosgranitsa» transferred the money for «Adler» reconstruction to the bank account of «RSU 5» in «Agrosoyuz» bank. However, Alexandr Bezdelov acquired the part of the bank  much later and this information wouldn't seem difficult to prove for the Investigative Department of the Russian Ministry of Internal Affairs (MVD).

 However, all mentioned inconsistencies make a completely false impression about the real actions of the inquiry in this case and about the real role of Dmitry Bezdelov. In turn, this allows to assume that the main police inquiry will be largely dissappointed in court.
