Former Head of Rosgranitsa is being persecuted for his civil stand

Dmitry Bezdelov, the former head of Rosgranitsa was the first one to file a complaint to court and law enforcement authorities when not the state contracts for the reconstruction of checkpoint “Adler” and “Pogranitchniy” were not carried out. In fact, a high-profile case was initiated and based upon the facts that were pointed out to the inquest by Bezdelov himself. One can only guess how he had been transformed from the complainant to the accused.


The first to contact police

There is a widespread prison joke in law enforcement system, which says: “the first one to contact the police is the right one”. In modern Russian history Dmitry Bezdelov, the former Head of Rosgranitsa can be considered the first person, who involuntarily disproved this folk saying.

In 2011 and 2012 he began to contact the authorities in connection to the state contracts about the reconstruction of railroad checkpoint «Adler» in Sochi and car checkpoint «Pogranitchniy» in Khabarovsk region that were not carried out by general contractors. And in 2013 he was accused himself.  According to prosecution, Dmitry Bezdelov is guilty of making complaints to courts and law enforcement authorities.

A particular cynism can be found in the fact that the state institution coincides: the former Head of Rosgranitsa had asked to protect the interests of the Russian treasury the same Ministry of the Internal Affairs, which investigative Department made acquisitions to him. Moreover, the point of the accusations is reduced to exactly the same circumstances that Dmitry Bezdelov had described in his court appeal and personal petition to Vladimir Kolokoltsev, the minister of Internal Affairs of the Russian Federation. And this situation cannot be written off to the change of management: Kolokoltsev had successfully managed the Ministry of Internal Affairs until now.

Generally, it seems that the respected minister is simply not aware of the real state of things in this high-profile story and what his subordinates are doing.


When you make a money return to the budget, you commit a fraud!

On April 7, 2011 the representatives of Rosgranitsa on the instructions of its then-Head, Dmitry Bezdelov addressed the Arbitration court of St. Petersburg and Leningrad Region with a lawsuit to LLC “Reconstruction department 5” (“RSU 5”) in St. Petersburg about the termination of contract regarding “Adler” and asking for reimbursement from LLC of approximately 1.4 bln roubles (the advance payment and forfeit). In its court appeal the “Rosgranitsa” representative had stated the LLC “Reconstruction department 5” (“RSU 5”) did not carry out its obligations according to the state contract, therefore it must return the money back, including the forfeit.

The Arbitration court has reviewed this case relatively long and only in January 2014 it made a “diplomatic” decision to terminate the contract and not to review the claims to return the money (before the other arbitration process on bankruptcy of LLC “Reconstruction department 5”   doesn’t finish). But, this is a completely different story.

On December 27, 2012 the representatives of “Rosgranitsa” acting upon the instructions of Dmitry Bezdelov appealed to the Arbitration court of Moscow region with a court appeal to “National insurance group”. In its appeal “Rosgranitsa” demanded from the insurance company to pay more than 820 mln roubles – this was the price of the insured state contract for the reconstruction of “Adler”. “Rosgranitsa” had won this legal process and “National insurance group” transferred the requested money to the budget (http://oglaskaspb.com/eng/authority/a303/).

Therefore, Dmitry Bezdelov has done everything in his power to protect the interests of the state company «Rosgranitsa» within the given contract. And on December 9, 2013, a year after the successful appeal of “Rosgranitsa” to the Artbitration court, the Investigative department has made a charge to Mr. Bezdelov on the account of fraud on the large scale. The inquiry has decided that the former head of “Rosgranitsa” had organized a theft of the funds, allocated for the reconstruction of the railroad checkpoint “Adler” that due to his efforts were practically in full returned to the budget at that moment.

However, it was only a beginning.


Himself to blame!

On September 22, 2014 an Investigative department of the Ministry of Internal Affairs accused Dmitry Bezdelov of committing a crime, according to Article 210 of the Criminal Code –“Setting up a criminal group”. The new accusation turned up after a new episode appeared in the case – according to the inquiry, the former Head of Rosgranitsa had not only organised the plundering of the money allocated for the reconstruction of “Adler”, but had also organised the theft of 130 mln roubles that were allocated for the construction of multiway carpoint “Pogranitchniy” in Khabarovsk region (http://oglaskaspb.com/eng/authority/a300/).

The charges were brought almost 2 years after Dmitry Bezdelov had sent a statement to Vladimir Kolokoltsev, where he had described in detail the fact of plundering budget funds, allocated for the reconstruction of “Pogranichniy” and asked to conduct a revision. In fact, in December 2012 the former Head of “Rosgranitsa” did everything, so that the Ministry of Internal Affairs initiated a criminal proceeding and returned the money, stolen by the frauds. And in less than a year, such an episode appeared in the case, however this time the main “fraud” was Dmitry Bezdelov himself.

The former head of “Rosgranitsa” has sent to Vladimir Kolokoltsev not one statement, but two. There, on 4 pages he described in detail the scheme, how the money were taken away from the budget, including the utilization of the dummy companies (with their names and banking details) and a fraudulent banking guarantee from “Summit bank”. To the statements were included 11 documents, included the ones faked by the criminals. In fact, the statements by Dmitry Bezdelov from December 2012 and January 2013 contain all the schemes how the state money, allocated for the reconstruction of “Pogranitchniy” were stolen.

Except for one detail, the complainant Dmitry Bezdelov somehow became an accused.
