General contractor of "Igora" puts up a brave front

How can one maintain his reputation after having been entangled in his own financial frauds and once trapped by lenders? Vladimir Vasilyev - the owner of the "Company Rus" (the general contractor of the elite ski resort "Igora") - came up with an unexpected decision - his debts will be paid off by his subordinate. This happened on the day when a unique decision by Russian justice came into force, due to which Vasilyev was brought to vicarious liability in bankruptcy of the "Company Rus".


Mr. Todua makes salvage from liability

September 14, 2012 - someone Koba Todua turned to the Arbitration Court of St. Petersburg and the Leningrad Region. He declared his readiness to repay debts of Vladimir Vasiliev to creditors in bankruptcy of the "Company Rus".  Actually, the "Company Rus" owes to LLC "TehnoBalt" almost 5.5 million rubles.

Koba Todua made his surprising announcement at the very day that the definition of arbitration court came into effect on bringing Vladimir Vasiliev to vicarious liability. This is a rare procedure for Russian justice, it prevented the development of the bankruptcy process, and now it scheduled to enter into an active phase.

One can assume that the owner and CEO of the "Company Rus" - Vladimir Vasilyev - did not expect that things would have taken such a nasty turn for him. Prior to that moment he treated the case rather haughtily: he did not respond to the legitimate demands of the administrator and did not take action in order to meet their financial obligations.

Apparently, Mr. Vasiliev had no idea that the administrator Igor Kuzmin would be able to identify numerous financial violations committed personally by the owner of the "Company Rus". Those violations have led to the bankruptcy of the company, which had been previously considered to be the largest producer of wooden cottages in the Leningradregion (we wrote about identified financial irregularities of Vladimir Vasiliev here: http://oglaskaspb.com/eng/auto/a60/). As a result, the bankruptcy procedure of "Company Rus" appeared to develop in an unexpected way - the unfortunate businessman occurred to beinvovled into vicarious liability and now has to pay almost 5.5 million rubles.

Moreover, the judge of the Arbitration Court of St. Petersburgand Leningradregion- Marina Antipinsky-seized the shares of Vladimir Vasiliev in other commercial structures to guarantee he carries on the definition (more on this here: http://oglaskaspb.com/eng/auto/a64/).


Reputation harm should take place

Once a definition of bringing the owner of "Company Rus" to vicarious liability has come into force, Koba Todua appeared in this trial, and declared his readiness to pay off all the debts of Mr. Vasiliev.

According to the materials of the arbitration case, Mr. Koba Todua expressed willingness to repay the debts of the bankrupt businessman. In fact, Mr. Todua is one of the leaders of the "Company Rus”, and a direct subordinate of Vladimir Vasiliev. Moreover, being an owner of the "Company Rus" , Vasiliev  is an employer to Todua.

The businessman is known in the media as a friend of the president of JSC "Russian Railways" Vladimir Yakunin (both share hobby of hunting, and it is due to this friendship "RZhD” recently concluded multibillion contracts with "Corporation P Industry" , which is also owned by Vasilyev); and it looks like businessman is trying to put up a brave front. After all, he can always say that he owed nothing to anyone, the arbitration administrator is making intrigues, and he had nothing to do with repayments by Mr Todua. If only Vladimir Vasiliev repays debts personally - he would actually admit to all the charges against him.

However, the described "ritual dances" would hardly compensate harm for the reputation of Mr. Vasiliev which he has already made by the described actions.

Arbitration manager Igor Kuzmin has already directed formal statements for the second time to the Chief of the Investigative Department of the MOI of Russia for theSt. PetersburgandLeningradregion- Marina Matveeva, and to the Vice President of Corporate Security of the"Russian Railways"- Alexander Bobreshov.

The manager asked Marina Matveeva to bring criminal proceedings against Vladimir Vasiliev under two articles of the Criminal Code: 195 ("misconduct in bankruptcy") and 159 ("fraud"). He also asked Alexander Bobreshov for copies of the documents based on which "Corporation P Industry"(owned by Vasiliev) has been allowed to participate in tenders for contracts for the construction of railways.

The latter requirement is directly related to the bankruptcy of "Company Rus" because virtually Vladimir Vasiliev was in debt at the time and still kept applying for billion contracts of "RZhD". Now "Corporation P-Industry" is arrested among other companies owned by Vasilyev; incidentally, it managed to win contracts in the "Russian Railways" worth more than 3 billion.

Now, unless there is something extraordinary, a businessman Vasiliev is awaiting prosecution and no more wins on tenders in the "Russian Railways". Even though he certainly hopes that the intervention by Todua citizen can change the situation.
