The fight against drug trafficking in Karelian way

The last former agent of the Federal Drug Control Service (Gosnarkokontrol), a participant of resonant drug criminal case in the Republic of Karelia confessed he had stipulated defendants under pressure of the directorate agents. In a day or two, the Republican Supreme Court will proceed the conviction in this case- the prosecution will come there with little evidence. The confessors claim they were getting drugs during the test purchases.

 

Minus an Episode

First, this criminal case looked similar to the mass of other cases: Federal Drug Control Service officers organized test purchases of drugs from two residents of Sortavala - Sergey Kablukov and Alexander Mamenchenko. Moreover, Mamenchenko appears in there quite a bit, and according to investigators, Kablukov is an active participant as much as 6 episodes.

Episodes in the statement of the investigator are extremely banal: according to investigators, using the pseudonym "Somov" Sergei Kablukov sold drugs twice to the agent of Gosnarkokontrol; as supposed by investigators, Kablukov sold the drugs twice to another agent Gasnarkokontrol using the pseudonym "Fisenko", at once a drug was withdrawn from a robe pocket of Kablukov’s wife in their apartment, and finally at once Kablukov allegedly sold drugs to a certain citizen Ilyinsky.

At the stage of preliminary investigation, the case was getting developed quite well, but at the first trial the prosecution ran into trouble.

At the begining, Alexander Mamenchenko refused his testimony. During the preliminary investigation, he confessed to drug trafficking, and denounced in the same Sergei Kablukov. At trial, he said it was a slander due to his ill health and pressure by investigator.

Then it turned out that the Mr. Ilyinsky purchases who, according to investigators, purchased drugs from Sergei Kablukov, never met Kablukova that day. One episode has automatically dropped then.

February 16, 2011 Sortavalsky City Court of the Republic of Karelia recognized Kablukov and Mamenchenko guilty of drug trafficking: Kablukov  was guilty on 5 criminal episodes, Mamenchenko - on 2 episodes. Kablukov was sentenced to 7.5 years in prison, Mamenchenko - to 6-year suspended sentence.

June 2, 2011 the Supreme Court of the Republic of Karelia overturned the verdict on appeal from the prosecutor's office; it was considered to be too soft. The case was sent back for retrial in Sortavala municipal court, and then everything happened all of a sudden.

 

Minus agents "Somov" and "Fisenko"

In the process of retrial prosecutor lost two more witnesses.

First, former Gosnarkokontrol agent "Somov" refused the earlier testimony. That was certain Alexey Babikov; he was "on the hook" of the Federal Drug Control Service because of drug addiction, and employees of the agency forced him to give false evidence against Sergei Kablukov. He went on about them, because he was threatened with prison, and he had to care for his sick grandmother. In addition, they promised him some relief in another criminal case he had been accused of.

Law enforcers did not keep their promises, according to Babikov; so he disliked being "Somov" any more. Babikov confessed that Kablukov had refused to sell him drugs in those two episodes- then they had to buy those from strangers and to form it as if that was Kablukov. Oksana Hannele, a friend of Alexis Babikov, provided similar testimony; she confessed that in the first trial she gave false testimony together with him.

A judge of Municipal Court of Sortavala, Andrey Mikheev apparently did not believe the new testimony of former agent "Somov" and his girlfriend. September 16, 2011 Kablukov and Mamenchenko were sentenced again: Kablukov -   to the same 7.5 years in prison, Mamenchenko - to 6 years, but now this is for real.

Assumedly the court based on an assessment of individuals accused: they were both drug addicts, and did not even try to hide it. However, there is a big difference between drug use and drug trafficking. In the first case, people satisfy their own addiction, in the second one they spread this drug disease to others.

Of course, the defendants disliked a harsher sentence; they filed appeals to the Supreme Court of the Republic of Karelia. On December 5, the fate of these guys will be judged again. And, it seems, surprises might happen: as we got to know the second former agent of State Drug Control Committee refused his testimony; he appeared in this case under the pseudonym "Fisenko" and turned out to be Valery Sokolov.

So, he said in his video interview (a copy of the record was provided to the editor’s office by Victor Kablukov, the father of one of the defendants): he met Sergei Kablukov in court for the first time; accordingly, he did do any purchases from him, and gave false testimony because he was feared of prosecution under another criminal case. Valery Sokolov promised that he was giving truthful testimony that time.

In fact, this means all the evidence collected for the 4 episodes out of 5 is rather questionable. So, it is interesting now: what is the solution of the Supreme Court of the Republic of Karelia going to be?

 

Price of a dose

There is another interesting aspect in this story.

Former Federal Drug Control Service agents told quite openly about their part in the so-called test purchases. This happens usually in the same scenario: agency staff gives them money to purchase drugs and equips appropriately. The agents meet with the specified object to buy drugs for the money given to them by taxpayers - and immediately run to the nearest hidden place to hit up.

Employees of Gosnarkokontrol get either pitiful remnants of the drug purchased, or do not get anything at all - they tend to "overlook" such nuances. Thus, the Federal Drug Control Service forms a cohort of stable drug addict; they are like zombies which are ready to fulfill any of the assignments of employees of this department for a dose.

In fact, government officials, who have been designed to combat the spread of drug addiction, on the contrary, are strongly contributing to it and extracting from it its own benefit. According to the case of Kablukov and Mamenchenko; this benefit is somewhat too far from the real fight against crime.
