Deceiving shareholders

The main initiators of legal and criminal prosecution in the bankruptcy process of LLC “Stroitelnyie Technologii” (“Construction Technologies”), the company which couldn’t pay out its obligations under the preliminary sales contract of the buildings on Yaroslavsky and Leninsky prospects, cannot be referred to as an actual shareholder company. There are so many claims to the company itself that a justifiable question arises - why the legal authorities haven’t taken an interest in the company so far. And the story behind how “Stroitelnyie Technologii” obtained its obligations in the first place is also somewhat dubious.


«Main» creditors

In the creditor’s register of LLC “Stroitelnyie Technologii” there are two filed claims from businessmen from St.Petersburg – Yuriy Greznev and Sergey Rusakov. According to businessmen they are entitled to apartments from “Stroitelniye Technologii” company for which they have already payed 2 million and 16 million roubles respectively. Presently the two parties appear to be active in court actions and file complaints to legal authorities.

As a result of their activity the Main Department of Investigation of Investigation Committee of the Russian Federation of St. Petersburg recently brought (http://oglaskaspb.com/eng/kommuna/a135/) a criminal case upon fraud, supposedly carried out by Igor Petrov, Direktor General of “Stroitelnyie Technologii”  in the process of dealings with shareholders and co-investors of the buildings on Yaroslavsky prospect. The fact of bringing up the case to some parties seemed fishy in itself– previously legal authorities claimed that company’s actions did not constitute a crime. Moreover, the parties take their complaints to Arbitration court.

We further investigated the dealings between the parties and the bankrupt «Stroitelnie Technologii» and found out some astonishing details that justifiably state a question of who is actually the fraud in this story.


Lousy investors

This story began in 2006 when the management of the leading developer company “Pantikapei” (the company constructs cottages in Leningrad region) was approached by Yury Greznev and Sergei Kamchugov.  They presented themselves as investors willing to construct 40 townhouses on the land plot that will be assigned to them. They were given a land plot under the conditions that they will in return give 15 townhouses with all the communications to the company- it was assumed that the townhouses will eventually be built. This story took place in a prestigious Vsevolzhsk region of St. Petersburg.

As construction works slowly took on, Sergei Kamchugov entered a new project: he purchased another three land plots located in the proximity. “Pantikapei” company planned to construct a cottage village there. The parties signed another agreement, where the developer gave to Kamchugov one of its houses that it was constructing at that time in other place and Kamchugov was to return a similar new house after the construction was finished.

The first part of the deal was carried out in a complex way: the house was registered on Kamchugov’s friend and Kamchugov in turn received the payment from both this person and from “Pantikapei’s” representatives in the amount of 5 million roubles. However, the second part of the deal was never completed.

By the end of 2007 it turned out that the 40 townhouses that were promised to be built by Kamchugov and Greznev were not being completed. This seemed suspicious as the shareholders already payed in full. In further scandal it was found out that three land plots where the promised house should have been constructed and returned to “Pantikapei” as a payment, were also already sold by Mr. Kamchugov.

The buyer of three land plots became “TechnoLine” company that at that time was being managed by Igor Petrov, a Direktor General of “Stroitelniye Technologii”.


Apartment wanted

An agreement between Igor Petrov and Sergei Kamchugov turned out to be more than unsophisticated: Petrov purchased from Kamchugov all the three land plots according to the market price. So far, as we found out, Mr. Kamchugov received approximately 3 million roubles according to the contract and about 300 000 Euro as part of a verbal agreement.

Additionally the parties agreed upon a further investment of a project. It was concluded that the land plots would be merged in order to build a cottage settlement there. In case of a successful completion of the project, Kamchugov and Greznev were to receive their own real estate objects. In order to secure the deal, the head of “Stroitelnyie technologii”  issued the businessmen the apartments in the houses on Yaroslavsky and Leninsky prospects that were being constructed at that time. At that stage Kamchugov and Greznev introduced to Petrov another businessman – Mr. Rusakov. Later it was found out that his financing was used in 2006 in order to buy the infamous 3 land plots from “Pantikapei”.

Therefore, Yury Greznev  became the owner of the preliminary contract for the purchase of an apartment in an uncompleted house on Leninsky prospect and a land plot #5, Sergei Ruakov – received has got 3 apartments in a house on Yaroslavsky prospect 78-a. The businessmen happily forgot their obligations to construct a settlement on 3 land plots sold to the by «Stroitelnyie Technologii», the obligations that entitled them to preliminary sales contacts for the apartments on Leninsky and Yaroslavsky prospects.


Surely they will never fulfil their obligations: to complete a procedure of merging 3 land plots in order to construct a cottage settlement proved unattainable. However, these facts do not prevent the businessmen from eagerly defending their reights for the apartments that belong to the bankrupt «Stroitelnyie Technologii» company.
